1. Agreement to Terms
By accessing or using the Streamtunes website at https://streamtunes.net (the "Service"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. About Streamtunes
Streamtunes is a music streaming platform operating and registered in the State of Nevada. The Service provides access to a library of music content.
3. Account Registration and Types
3.1 Free Account
You may register for a free account on the Service. With a free account, you can:
- Preview the first 60 seconds of any song in our library
- Like and dislike songs to personalize your experience
- Browse our music library
Free accounts do not provide access to full-length songs. You may preview the first 60 seconds of a song with a free account. You must subscribe to our monthly subscription service to gain access to full songs.
3.2 Guest Access
Even without registering for an account, visitors to the Service can preview the first 60 seconds of any song. However, guest users cannot like/dislike songs, create playlists, or subscribe to the Service.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Music Preview Policy
All users, whether registered or not, can preview the first 60 seconds of any song available on the Service at no charge. This preview functionality is provided to help you evaluate music before subscribing to the Service.
Beyond the 60-second preview period, access to the full song requires an active monthly subscription.
5. Monthly Subscription
5.1 Subscription Features
By subscribing to our monthly subscription service, you gain unlimited streaming access to all songs in our library for the duration of your active subscription. The subscription price is displayed at the time of subscription and may be subject to change with advance notice.
5.2 Billing
Subscriptions are billed monthly through our payment processor on a recurring basis. Your subscription will automatically renew each month unless you cancel it. By subscribing, you authorize our payment processor to charge your payment method at the beginning of each billing period according to their terms of service.
5.3 Cancellation
You may cancel your subscription at any time through your account management page. When you cancel:
- You will be asked to confirm your cancellation
- Your subscription will remain active until the end of your current billing period
- You will continue to have full access to all songs until your subscription end date
- You will not be charged for any subsequent billing periods
After your subscription end date, you will only be able to preview the first 60 seconds of songs.
5.4 No Refunds
All subscription payments are final. We do not offer refunds for subscription fees. We encourage you to use the 60-second preview feature before subscribing.
6. Account Deletion
You may delete your account at any time through your account management page. Before deleting your account, you will be notified of the following consequences and asked to confirm:
- All your account data will be permanently deleted
- Your playlists will be deleted
- Any active subscription will be cancelled
- This action cannot be undone
If you create a new account in the future, you will need to resubscribe to access full songs. Previous subscriptions cannot be restored or transferred to a new account.
7. Playlists
Registered users with an active subscription may create and manage playlists. Playlist functionality is subject to the following conditions:
- With an active subscription: You may add any song from our library to your playlists
- Without a subscription: Playlist functionality is limited
- If your subscription ends or is cancelled: Songs will be removed from your playlists after your subscription end date
8. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to circumvent any technological measures we use to protect the Service or content
- Download, copy, reproduce, distribute, or create derivative works from any content except as expressly permitted
- Use any automated systems or software to extract data from the Service (scraping)
- Share your account credentials with others or allow others to use your account
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or modify any copyright, trademark, or other proprietary notices
- Use the Service in any manner that could damage, disable, or impair the Service
- Resell, redistribute, or commercially exploit any content obtained from the Service

Monetize content in any of the following categories:
- Adult content and services: Content that contains nudity or explicit sexual acts (e.g., subscriber-only nude images, adult audio/video live chat)
- Intellectual property or proprietary rights infringement
- Copyright-infringing content (e.g., leaked music albums)
- Violent extremism: Content that engages in, encourages, promotes or celebrates unlawful violence or hate speech toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic
9. Intellectual Property Rights
9.1 Service Content
All content available through the Service, including but not limited to music, artwork, text, graphics, logos, and software, is the property of Streamtunes or its content suppliers and is protected by United States and international copyright laws.
9.2 AI-Generated Content
Some of the music available on the Service has been generated using artificial intelligence technology (ChatGPT or similar).
9.3 Trademarks
"Streamtunes" and associated logos and marks are trademarks of the operator. You may not use these marks without prior written permission.
10. Creators and Third-Party Content
10.1 Becoming a Creator
Users may apply to become creators on Streamtunes. Creators may upload their original music to the platform for streaming. To become a creator, you must:
- Successfully onboard with Streamtunes, its designated tax service, and its designated payment processor so that we can pay you stream-based earnings for streams of the music you upload to the Service
- Provide accurate, complete, and current information during onboarding, including required tax documentation
- Have original music that you own or have sufficient legal rights to distribute
- Comply with all applicable local, national, and international laws and regulations related to music distribution and monetization
10.2 Creator Responsibilities
As a creator on Streamtunes, you are solely responsible for:
- Ensuring you hold all necessary copyrights, licenses, and permissions to upload and distribute your music
- Resolving any disputes, claims, or legal issues arising from your music or creator activities
- Ensuring your content does not infringe or violate the rights of any third party
- Complying with all applicable tax, reporting, and regulatory obligations
10.3 Stream-Based Earnings and Payments
Creators may earn stream-based earnings from streams of their music on the platform under the following structure:
- Pay Rate: Creators are paid per stream at a rate established at the time of creator onboarding (typically $5.00 per 1,000 streams, or $0.005 per stream). This rate is locked in for the lifetime of the creator account unless modified by written agreement or required by law.
- Stream Definition: A stream is counted when a user plays a song for at least 30 continuous seconds without seeking or looping.
- Payout Schedule: Stream-based earnings are processed weekly, every Monday at 1:00 AM UTC, subject to payment processor availability and compliance checks.
- Minimum Payout: Creators must accrue at least $5.00 in unpaid stream-based earnings to receive a payout.
- Payment Frequency: Creators may receive no more than one payout per week.
- Payment Method: All payouts are issued through Streamtunes' designated payment processor. Streamtunes does not custody creator funds.
- Receipts: Creators will receive an electronic, itemized payout receipt detailing stream counts and earnings, subject to payment processor availability and compliance checks, and as long as there are no technical issues.
- Example: If a creator accrues 1,000 total qualifying streams at $0.005 per stream, the creator earns $5.00 and will be paid on the next eligible payout date.
10.4 No Guaranteed Earnings
Creators acknowledge that stream-based earnings are not guaranteed. Earnings depend on factors including, but not limited to, user activity, listener behavior, availability of the Service, compliance with these Terms, and platform policies. Streamtunes makes no guarantees regarding minimum streams, earnings, exposure, promotion, or revenue.
10.5 Creator Eligibility and Service Location (Platform Policy)
Streamtunes supports paid creator participation only if:
- You are a U.S. person for U.S. tax purposes; or
- You are not a U.S. person and you will perform all creator activities for Streamtunes entirely outside the United States.
Creators who are not U.S. persons and who will perform any creator activities while physically present in the United States are not eligible to receive payouts through the Service at this time.
For purposes of this section, creator activities include uploading content, managing or modifying uploaded content, maintaining a creator account, and any other actions related to monetized participation on the Service.
10.6 Taxes and Reporting
Creators acknowledge and agree that they are solely responsible for determining, reporting, and paying all applicable taxes arising from payments received through the Service, including but not limited to income taxes, self-employment taxes, VAT, GST, sales taxes, or similar obligations.
Streamtunes does not provide tax advice.
Creators may be required to submit valid tax documentation, including IRS Form W-9, W-8BEN, or W-8BEN-E, or non-U.S. equivalents, as a condition of receiving payments.
Failure to provide required documentation may result in delayed payouts, backup withholding, or suspension of payments as required by law or Platform policy.
Streamtunes may issue required tax reporting forms, including IRS Forms 1099-NEC, as required by law.
All rates, examples, and payout references are stated in gross amounts before any applicable taxes, withholdings, processor fees, currency conversion fees, or legally required deductions.
10.7 Independent Contractor Relationship
Creators participate in the Service as independent contractors. Nothing in these Terms creates an employment, partnership, joint venture, fiduciary, or agency relationship between Streamtunes and any creator.
10.8 Song Deletion by Creators
Creators may delete their songs at any time through their account management page. Upon deletion:
- The song is immediately removed from the platform and no longer available for streaming
- The song files are deleted from storage
- The song is removed from playlists, recommendations, and search results
Deletion of a song does not affect the creator's right to receive unpaid stream-based earnings accrued prior to deletion, subject to the minimum payout threshold, compliance requirements, and applicable law.
10.9 Creator Account Closure or Deactivation
If a creator closes their account, ceases participation, or has creator status deactivated:
- All uploaded music is immediately removed from the platform
- All song files are permanently deleted from storage
- Content is removed from playlists, recommendations, and search results
Unpaid stream-based earnings accrued prior to account closure remain payable subject to minimum payout thresholds, compliance requirements, applicable law, and payment processor rules.
11. Privacy and Data Collection
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
12. Service Modifications and Availability
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also modify these Terms from time to time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. Technical issues, maintenance, or other circumstances may result in service interruptions.
Our platform relies on third-party service providers for hosting, payment processing, and other functionalities. We are not responsible for the actions or failures of these third-party providers, and such failures may impact the availability or functionality of the Service.
We are not liable for any loss of data, revenue, or other damages resulting from service interruptions or modifications. We recommend that you regularly back up any content you upload to the Service.
13. Account Suspension and Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users, third parties, or our business interests
- Violates applicable laws or regulations
- Is fraudulent, abusive, or otherwise objectionable
- Involves unauthorized use of the Service or accounts
- For any reason at our sole discretion
Upon termination, your right to use the Service will immediately cease. We are not obligated to provide refunds for any prepaid subscription fees upon termination for cause.
14. Disclaimers and Limitation of Liability
14.1 Service Provided "As Is"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
14.2 No Warranty on Content
We do not warrant that the content available through the Service will meet your requirements or that it will be error-free, virus-free, or secure. We make no guarantees regarding the quality, accuracy, or availability of any content.
14.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMTUNES AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code that may be transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
- The deletion of, loss of, or failure to store any content and data maintained or transmitted through the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).
15. Indemnification
You agree to indemnify, defend, and hold harmless Streamtunes, its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any applicable laws or regulations
16. Dispute Resolution and Governing Law
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
16.2 Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be filed exclusively in the state or federal courts located in Nevada, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
16.3 Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Nevada before a single arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.
16.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
18. Entire Agreement
These Terms constitute the entire agreement between you and Streamtunes regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter.

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
